Florida tourist tax late penalties: how they add up, and how to stop them
Last checked Oct 26, 2026 from official sources. Not tax advice.
Florida’s penalties are built to punish lateness, not just unpaid tax. Even a return with nothing due costs money if it’s late, and the interest and penalties really hurt.

| Penalty | 10% of the tax for each 30 days (or part) late, up to 50%, with a $50 minimum (Okaloosa and Bay County FAQs; Fla. Stat. 212.12 pattern). |
|---|---|
| $0 returns | Late zero returns are charged the $50 minimum (Okaloosa, Bay; Manatee says the minimum applies “even if no tax is due”). |
| Interest | A floating rate the Department of Revenue sets each January 1 and July 1, from the due date until paid. |
| Collection allowance | Lost. On-time filers keep 2.5% of the first $1,200 of tax (Okaloosa, Bay), or 2.5% capped at $30 a month for electronic filers (Manatee). |
| Beyond that | Walton’s Clerk warns of liens and other collection action, and says rental ads are checked regularly. |
Why monthly matters
Because every month is its own return, one forgotten season becomes several separate late returns, each with its own minimum penalty. An owner with a quiet winter who stops filing can owe penalties for months in which no one stayed.
How to stop the clock
- Come forward first. Walton’s Clerk says timely voluntary disclosure, before the county contacts you, “will minimize interest and result in the waiver of penalty charges.” Ask your county whether it offers the same.
- File the missing months in order, including $0 months, and pay the tax first so interest stops growing.
- Follow our catch-up guide or the Walton, Bay and Okaloosa version.
Questions owners ask
